- Acceptance of Terms
By accessing or using kingdomshift Media (the "Platform"), operated by kingdomShift Media Corp ("We," "us," or"our"), you ("User," "you," or "your") agree to comply with and be legally bound by these Terms of Use ("Terms") and our Privacy Policy. If you do not agree, please do not access or use the Platform.
2. Eligibility and Inclusive Use
2.1 Eligibility:
You affirm that you are at least 13 years old. Users betweenthe ages of 13 and 17 must have consent and supervision from a parent or legal guardian to use the platform. If you are under 13 years old, you are not permitted to use the Platform.
2.2 Parental Consent for Minors:
Users aged 13 to 17 must have a parental of legal guardian complete and submit a digital Parental Consent Form prior to full access. Until such consent is recieved and verified, access to certain features of the Platform may be restricted or denied.
2.3 Inclusivly:
Kingdomshift Media welcomes all users without discrimination based on race, ethnicity, religion, nationality, gender, sexual orientation, or any other status. We promote a safe, respectful, and uplifting enviornment that honors God and reflects Kingdom Values.
3. User Account and Security
3.1 You may be required to register for an account and provide accurate, complete, and current information.
3.2 You are responsible for safeguarding your account credentials and all activities that occur under your account.
3.3 Notify us immediately if you suspect any unauthorized use of your account.
4. User Conduct and Content Rules
4.1 Lawful and Respectful Use:
You agree to use the Platform lawfully and in a manner consistent with Kingdomshift Media's mission to honor God, encourage kindness, truthfulness, and community upliftment.
4.2 Prohibited Content and Conduct:
You must not post, upload, transmit, or distribute any content or engage in conduct that:
- Is unlawful, defamatory, abusive, harassing, hateful, violent, sexually explicit, obscene, fraudulent, misleading, or harmful;
- Violates intellectual property or privacy right;
- Contains viruses, malware, or other harmful components;
- Promotes illegal activity or hate speech;
- Exploits minors or vulnerable persons.
4.3 Content Responsibility:
You are solely responsible for any content you submit or share on the Platform. You represent that you hold all necessary rights and permissions and that such content complies with these Terms.
4.4 Content License:
By submitting content, you grant Kingdomshift Media a perputual, worldwide, royalty-free, sublicensable license to use, reproduce, modify, adapt, publish, translate, distribute, perform, and display your content for Platform operation and promotion.
4.5 Monitoring and Enforcement:
We reserve the right, but have no obligation, to monitor, review, or remove any content or suspend accounts that violate these Terms or harm the Platform community.
5. Intellectual Property Rights
5.1 Ownership:
Kingdomshift Media and its licensors retain all intellectual property rights in the Platform's software, content, logos, trademarks, and related materials.
5.2 User License:
We grant you limited, non-exclusive, non-transferable license to access and use the Platform for personal, non-commercial purposes subject to these Terms.
5.3 Restrictions:
You may not copy, modify, distribute, create derivative works from, or otherwise exploit any Platform content without express written consent.
6. Advertising
6.1 Advertisers must comply with KingdomShift Media's Advertising Terms and ensure ads align with our values.
6.2 We reserve the right to approve, reject, or remove advertisements or sponsored contentfor any reason.
7. Privacy
Your use of the Platform is governed by our Privacy Policy, available at www.kingdomshiftmedia.com/privacy, which explains how we collect, use, and protect your personal information.
8. Disclaimers and Limitations of Liability
8.1 No Warranty:
The Platform is provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.
8.2 No Guarantee of Availability:
We do not guarantee uninterrupted or error-free operation or that the platform will be free of viruses or harmful-components.
8.3 Limitation of Liability:
To the fullest extent permitted by law, KingdomShift Media and its affiliates, officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the Platform.
8.4 Indemnification:
You agree to indemnify, defend, and hold harmless KingdomShift Media and its affiliates from any claims, liabilities, damages, losses, and expenses, including legal fees, arising from your violation of these TERMS OF APPLICABLE laws.
9. Termination and Suspension
9.1 We may suspend or terminate your access to the Platform at any time, with or without cause or notice, especially in case of violations.
9.2 Upon termination, all rights granted to you will immediately cease.
10. Governing Law and Jurisdiction
10.1 These Terms are governed by and construed under the laws of the State of Hawaii, USA, Hawaii without regard to conflicts of law principles.
10.2 Any disputes shall be resolved exclusively in the state or federal courts located in Honolulu County, Hawai'i. You waive any objection to the jurisdiction and venue of such courts.
10.3 To the maximum extent permitted by law, you waive any rights to a jury trial or class action related to disputes with KingdomShift Media.
11. International Users
KingdomShift Media is intended for users located primarily in the United States. Users accessing from other jurisdictions are responsible for compliance with local laws.
We do not guarantee compliance with non-U.S laws and disclaim liability for any violations thereof.
12. Changes to Terms
We reserve the right to update or modify these Terms at any time. Changes will be posted on the Platform with the updated effective date. Your continued use after such changes constitutes your acceptance.
13. Severability
If any provision is found unenforceable or invalid by a court, the remaining provisons will remain in full effect.
14. Entire Agreement
These Terms, along with the Privacy Policy and any other posted policies, constitute the entire agreement between you and KingdomShift Media relating to the Platform and supersede all prior agreements.
15. Parental Consent for Minors
